I. INTRODUCTION
Before registering yourself for the L’ORÉAL EStrat, you must read these rules (hereinafter called the “Official Rules”) in its entirety. By completing the registration form, thereby register yourself, you accept without reservation the conditions of the Official Rules. Furthermore, you accept that any decision of L’ORÉAL concerning the L’ORÉAL EStrat shall be firm and definitive.
II. THE L'ORÉAL ESTRAT CHALLENGE
a. The L’ORÉAL EStrat Challenge (hereinafter called the “Game”) is an Internet game organized by L’ORÉAL, a joint stock company with share capital of € 135,212,432,located at 14 Rue Royale, 75008 Paris, France, registered in the Trade and Companies Register under number 632 012 100, (hereinafter called “L’ORÉAL”).
b. The purpose of the Game is to familiarize students with the strategic realities of companies within the cosmetics industry facilitated by the technological potential of the Internet. This project is a part of the Human Resources communication strategy of L’ORÉAL and is aimed to develop the image of L’ORÉAL among students in its strategic and business dimensions.
c. The Game is based on an interactive economic simulation where the participants evolve within the competitive environment of the cosmetic products industry and manage a portfolio of brands. The decisions taken by the participants will affect the key factors for success.
d. The Game will take place in 5 stages:
- Stage 1: Registration
- Stage 2: Selection “Round 1”
- Stage 3: Online Competition (Rounds 2-5)
- Stage 4: Semi-Finals (Round 6 and Business Plan)
- Stage 5: International Final
e. The Game will begin on 3er November 2008 and terminate on the 16th April 2009.
f. It shall be possible to compete in the L’ORÉAL EStrat in two different ways:
- The Open Challenge is played independently of an academic course. Students register in teams of 3 by using the internet registration form and must follow the deadlines set for in the Official Rules without the direction of a Professor.
- The Academic Challenge is organized within the framework of an academic course, with the supervision of a Professor who has decided to participate in the Game, and as such, be responsible for the practical organization of the Game according to the rules set forth by L’ORÉAL. This method of participating is reserved for students who are registered in these specific courses offered at schools predetermined by L’ORÉAL. The Academic Challenge teams participate in teams of 3 Students in the selection process (Stage 2) of which they are not subject to elimination. Academic Challenge students are directly eligible to participate in the whole Online Competition (Stage 3). The EStrat simulation used by Academic Challenge teams is similar to the simulation used by Open Challenge teams, but it does not deliver the automatic feedback after each round that Open Challenge teams get.
These two different ways of participating in the Game only affect, the selection Stage 2: “Round1” and the Stage 3: “Online Competition (Rounds 2-5)”.
g. The final results will be announced on the L’ORÉAL EStrat Challenge site, www.EStrat.loreal.com (hereinafter called “the Site”) after each round during Stages 2 through 4 of the Game and after the International Final.
III. PARTICIPATION
a. Participation in the Game is open to any persons officially enrolled in a school or a university of higher education registered in their last or penultimate year of studies and will to graduate in 2008, 2009 or 2010 (hereinafter called “the Students”). Students doing their thesis or achieving the equivalent in order to obtain their diploma can also be considering as students. Once a student obtained their diploma or equivalent in their country’s university or schoool should not be considered anymore as a student.
b. Participation in the Game within the framework of the Academic Challenge, the Student must fulfil the conditions stipulated in section a.) above, and must also be registered in one of the participating courses at a school selected by L’ORÉAL.
c. The Student must fulfil the conditions stipulated in a.) to participate in the Open Challenge, and in b.) to participate in the Academic Challenge, on the last day of registration, namely 17th of January 2008.
d. The Students participating in the Game cannot at any time during the Game be employees, apprentices, trainees, or interns of StratX or of the L’ORÉAL Group.
The Students in the process of being recruited for a job, an apprenticeship, traineeship, or internship at StratX or the L’ORÉAL Group are admissible for the Game. However, they shall be automatically disqualified if their recruitment is finalized and in effect by either of the above-mentioned companies, beginning from the date of actual the commencement of employment.
e. Persons who participated in any of the International Finals of the first 8 editions of the L’ORÉAL EStrat may not participate in the Game.
f. Participation in the Game is subject to online electronic acceptance of the Official Rules and of the documentation concerning the assignment of the intellectual property and image rights.
g. Under age students must have the consent of his/her parents or of his/her guardian to accept the Official Rules and to participate in the L’ORÉAL EStrat Challenge.
h. No financial contribution or obligation to purchase is required.
i. The participation in the Game may not in any event be considered as giving rise to contractual relations with L’ORÉAL or one of its subsidiaries and, in particular, may in no event give rise to an employment relationship.
IV. REGISTRATION
a. The Students must register in teams of 3 members (hereinafter the “Teams”) between the 3rd of November 2008 and the 17th of January 2009 at 9:00 a.m. Paris time, inclusive (hereinafter called “the Registration”). Teams can change any of the required information specified in the registration form except for their team name and password until the date of submission of the first round, at the latest January 20th, 2008 at 9:00 am Paris time.
b. The Teams must use the official registration form available on the Site (hereinafter called “the Registration Form”).
c. The Registration Form specifies the fields that must obligatorily be completed. Incomplete registration forms will not be considered as eligible to submit the decisions of Round 1. If it appears that a candidate has given the wrong information concerning the registration, his/her team will be disqualified.
d. At the time of Registration, the Teams will be requested to accept the Official Rules. Failing to do so, it will not be possible to submit the Registration Form. Acceptance of the Official Rules in the name of the Team by the member of the Team who has personally submitted the Registration Form shall be deemed to amount to acceptance by the other members of the Team.
e. The Teams must choose a team name (hereinafter called “the Team Name”). This will be used in any subsequent communication during the Game. This Team Name cannot be modified. L’ORÉAL reserves the right to ask the Teams to modify the Team Name if this name could be deemed offensive.
f. The Teams must also choose a password. This password may not be modified.
g. The Team Name and the password shall be necessary to modify the Registration Form. They will also be necessary to have access to certain elements of the Site.
h. All the members of the Teams must provide a valid personal e-mail address. The mention of a professional e-mail address is strictly forbidden.
i. L’ORÉAL reserves the right to verify the validity of the information provided by the Teams at the time of the Registration and at any time during the Game and to request copies of the identity cards and/or student cards of the school or university mentioned by the Team.
j. The Students must register in the categories of “MBA Team” or “Undergraduate Team”. Teams cannot change their category. Teams or students registered and playing the Game in the wrong category will automatically cause the disqualification of the Team and all its members.
L’ORÉAL designates by :

“MBA Team”, consists a Team whose 3 Students who
- Have significant professional experience.
- Are officially registered in a Masters of Business Administration course from the same officially recognized MBA School or University
-
“Undergraduate Team”, consist of a Team of 3 Students who
- Are officially registered in an Undergraduate program the same school or university
- Are officially registered in a Masters program at the same school or university
All Masters programs are included in the Undergraduate category excluding the MBAs.
k. Students may only be members of one Team. Any Student registered in more than one Team would cause the automatic disqualification of all of the Teams of which he/she is a member.
l. In the event that the number of players in a Team is reduced to less than 3 members, the Team shall be disqualified. However, L’ORÉAL reserves the right, not to disqualify teams in which a team member had a legitimate reason to leave their teams, as long as there are at least 2 team members continuing the game. The reasons considered as legitimate by L’ORÉAL are the following: pregnancy, accidents or hospitalization.
m. Students must register under the first name and surname appearing on their passport.
V. SELECTION OF THE TEAMS
a. The selection of the Teams will take place from the 20th to the 22nd of January 2009. (hereinafter called “the Selection"). Teams haven’t duly completed their registration form at the latest on the January 17th 2009 at 9:00 a.m. Paris time will not be eligible for this selection.
b. This stage does not involve the teams participating in the Game within the framework of the Academic Challenge, which shall be automatically selected, without regard to their score or ranking, following their Registration.
c. First Selection “Round 1” aims to select the teams which achieved the highest Share Price Index (hereinafter called “SPI”) score by geographic zone (hereinafter called “Zones” and by country and based on the established quotas per country, in order to ensure an international representation of the teams.
d. “Round 1” corresponds to a 6-month economic cycle.
e. The Teams use a software (hereinafter called the “Software”) in order to prepare and communicate their decisions on the Site. The Teams shall use their team name and password each time they use the software.
f. The SPI measures the share value of the teams. The SPI is determined by the Team’s action, and takes into account several indicators such as: market shares, growth, profitability, and corporate social responsibility indices.
All competing Teams have the same SPI at the beginning of “Round 1”. The SPI is then calculated by the Software for each Team.
g. The Selection Quotas applied in order to ensure the Teams international representation will be the following:
- 7% minimum per Zone
- 15% maximum per country
The Zones are defined in Appendix 1 of this document. Zones take into account the location (country) of the school / university of the Teams. For Students following correspondence courses, the Zone is determined by the location of the administrative centre of the school or the university.
h. At the end of “Round 1”, 1,275 Teams will be selected to participate in the Game within the framework of the Open Challenge. 425 Teams will automatically selected from the Academic Challenge.
However if the number of Teams registered for the Game within the framework of the Academic Challenge is less than 425, L’ORÉAL reserves the right to select a number in excess of 1,275 to participate in the Game within the framework of the Open Challenge, the objective being to have a minimum of 1,700 Teams competing in the Game.
i. The announcement of the Selected Teams shall be made by e-mail to the members of the Teams and displayed on the Site on the 23rd of January 2009 at no later than 16:00 p.m. Paris time.
VI. THE COMPETITION
a. From the 23rd January 2009 to 9th February 2009 at 9:00 a.m. Paris time, inclusive, the Selected Teams within the framework of the Open Challenge shall take part in “Rounds 2 to 5”, (hereinafter called “the Online Competition”) according to the calendar, set out in article VI.
b. The Teams of the Academic Challenge shall also take part in the same Rounds according to the same rules but at dates which may be different. These dates will be communicated to the Teams by their professors. However, they shall also finish their 5 Rounds at the latest on the 9th of February 2009 at 9:00 a.m. Paris time.
c. The Selected Teams of the “Open Challenge” and teams participating in the “Academic Challenge” will start “Round 2” with their scores of the “Round 1”.
d. Each Period of the simulation corresponds to a simulated 6-month economic cycle.
A Round of the competition is a period during which:
- Teams are granted access to a team file including general industry data relating to the previous period of activity of their virtual company.
- Teams shall analyze this data, agree on a strategy and implement it by making and submitting decisions in the EStrat Software.
- Teams shall submit their decisions for a run of the simulation Software, before the deadline of the Round.
At the end of each Round, StratX will run the software model, which will generate a new set of industry data.
e. The Selected Teams shall use the Software to prepare and communicate their decisions to the EStrat server (hereinafter called “Decision Round”). The Software may be downloaded from the Site at the latest two days after your registration date. The Teams must provide their Team Name and their password every time that they use this Software.
The objective of the Selected Teams during the Rounds shall be to obtain the highest SPI within their Zone. The SPI is then calculated by the “Software” for each Team.
f. The Selected Teams that communicate their Decisions after the deadlines fixed for the competition shall be disqualified.
g. The Online Competition, consisting of 4 Rounds (Round 2 to 5), shall take place between 23rd January 2009 16.00pm Paris time to 9th February 2009 9.00am Paris Time.
Teams will be asked to play Round 2 to 5, and submit their Round 5 decisions at the latest by February 9th 2009 9.00am Paris Time.
The Ranking for Round 5 and the selection of the 300 semi-finalists teams shall be displayed on the Site on the 13th of February 2009 at no later than 16:00 p.m. Paris time.
VII. THE SEMI-FINAL
a. The Semi-Finals shall take place from 13th of February 2009 from 16:00 p.m. Paris time, to the 27th of February 2009 at 9:00 am Paris time (hereinafter called “the Semi-Finals”).
b. A total of 300 Teams shall be selected from the Open Challenge and the Academic Challenge to participate in the Semi-Finals.
c. Selection for the Semi-Finals includes four steps
- Step 1: Selection of a maximum of 75 Academic Challenge Teams
- Within the academic challenge, the Teams shall be ranked in a decreasing manner depending on their SPI at the end of Round 5, (hereinafter called the “Academic Challenge Round 5 Ranking”).
- Selection of the best 75 academic challenge teams based on their SPI results on the academic challenge round 5 ranking
- A selection quota of maximum 5 teams per Academic challenge shall apply
- Step 2: Selection of 225 Open Challenge Teams
- 1. More Open challenge teams shall be selected to obtain the 300 semi-finalists if less than 75 Academic challenge teams have been selected.
- 2. Within the Open challenge, the Teams shall be ranked in a decreasing manner depending on their SPI at the end of Round 5, (hereinafter called the “Open Challenge Round 5 Ranking”).
- 3. Selection of the best Open Challenge Teams based on their SPI on the Open Challenge Round 5 Ranking
- Step 3: breakdown of the Teams by Zone, to apply geographical quotas and ensure a fair representation of teams in the world.
- a minimum of 7% of Teams per Zone
- a maximum of 15% of Teams per country
- Step 4 : the selection of the Teams according to the MBA and Undergraduates Zone Quotas
In order to select the Teams which shall participate in the Semi-Finals, a minimum of 5 MBA and 5 Undergraduate Teams shall be applied to the Ranking to maintain a certain competition between the best Teams of each of the two categories (MBA and Undergraduate) for each Zone.
d. The announcement of the Teams which shall participate in the Semi-Finals (hereinafter called the “Semi-Finalist Teams”) shall be communicated by e-mail to the members of the Teams and displayed on the Site on 13th of February 2009.
e. The Semi-Final shall include two assignments which shall take place simultaneously: - playing Round 6 of the Simulation and the drafting of a Business Plan.
f. Round 6 The execution of Round 6 shall be identical to that of the Rounds which took place during the Online Competition.
g. The Business Plan
The instructions for the Business Plan that the Semi-Finalists must send to L’ORÉAL shall be communicated on 13th February 2009 on the Site.
Each of the Business Plans shall be corrected and marked from 0 to 100 by a jury of experts (hereinafter called “the Business Plan Jury”). The Business Plan Jury shall be composed of L’ORÉAL managers.
The marking grid for the Business Plans shall be communicated on 13th February 2009 on the Site and annexed to the Official Rules on the same date, at the latest.
The two assignments of the Semi-Finals must comply with the following timetable:

The marking of the Semi-Finalist Teams shall be done as follows:
- The SPI obtained by the Open Challenge Semi-Finalist Teams at the end of Round 6 shall be marked from 0 to 100 based on the best Open Challenge team SPI result
- The SPI obtained by the Academic Challenge Semi-Finalist Teams at the end of Round 6 shall be marked from 0 to 100 based on the best Academic Challenge team SPI result
- The Business Plans shall be marked from 0 to 100
- A coefficient of 50% shall be attributed to the SPI and another coefficient of 50% shall be attributed to the mark for the Business Plan to obtain a single overall mark (hereinafter called “the Overall Mark”) at the end of the Semi-Finals.
VIII. THE INTERNATIONAL FINAL
a. The international final shall take place in April 2009 in the Paris region (hereinafter called “the International Final”).
b. 16 Teams shall participate in the International Final (hereinafter called “the Finalist Teams”):
- the MBA Semi-Finalist Team having obtained the highest Overall Mark in each of the 8 Zones
- the Undergraduate Semi-Finalist Team having obtained the highest Overall Mark in each of the 8 Zones
c. L’ORÉAL may, in no event, be held liable if a Finalist Team is unable to travel to France to participate in the International Final.
d. If, for any reason, one of the Finalist Teams should be disqualified, the Semi-Finalist Team having obtained the second highest Overall Mark in the Zone and the category concerned (MBA or Undergraduate) would be selected to participate in the International Final.
e. The Finalist Teams must defend their strategy before a jury (hereinafter called “the Presentation”).
f. There will be one jury for the MBA category and one jury for the Undergraduate category (hereinafter called “the Juries for the Finals”).
g. The Juries for the Finals shall be composed of L’ORÉAL managers and of members of the L’ORÉAL EStrat Committee (employees of L’ORÉAL or of Business Partners, etc).
h. The date, the exact place and the time of the Presentation of the Teams shall be communicated by L’ORÉAL at the latest by the 9th March 2009.
i. The marking of the Finalist Teams shall be done as follow:
• The Presentation is marked from 0 to 100
• The Presentation mark obtained will tell who is the winner of each category
• One price will be awarded to the team with the best SPI of each category among the 16 International Finalist
j. The round trip travel for the International Final for the Finalist Teams shall be reserved and paid by the local country L’ORÉAL office.
k. Accommodation in Paris shall be reserved by L’OREAL but paid by the local country L’ORÉAL office.
l. The final ranking of the International Final shall be posted online on the Site at the latest within 24 hours after the conclusion of the International Final Competition.
m. Participant countries can organize a National Final. These National Finals are completely independent from the International Finals and the national finalists can not be considered to take part in the International Finals unless they are one of the 16 Teams mentioned in VIII, b.

IX. INVOLVEMENT OF L'ORÉAL AND/OR STRATX PERSONNEL DURING THE GAME
a. Communication between the Teams and L’ORÉAL about the Game shall be exclusively carried out by e-mail. Any question concerning the Game must be sent via the contact page of the Site.
L’ORÉAL shall do its best to answer the questions on the “FAQ” page of the Site. However, no guarantee of an answer or an answer time may be given. Furthermore, L’ORÉAL reserves the right not to answer the questions if it is judged that an answer would give an unfair advantage to certain Teams.
b. The Students undertake not to request any information relating to the Game from the employees, apprentices and trainees of L’ORÉAL, of the companies in the L’ORÉAL Group and of StratX.
c. Students who have received unofficial or content sensitive information relating to the Game with the intent of allowing an unfair competitive advantage, from employees, apprentices and trainees of L’ORÉAL, or from the companies in the L’ORÉAL Group and of StratX must immediately inform L’ORÉAL.
X. INVOLVEMENT OF PERSONNEL OF THE UNIVERSITIES/SCHOOLS
The assistance of professors and/or the staff of the university and/or the schools must be limited to general information relating to strategy. Unauthorized or excessive assistance shall entail the disqualification of the Team.
Back to the topXI. USE OF THE EStrat CHALLENGE CONCEPT BY THE HUMAN RESOURCES TEAMS OF THE L'ORÉAL GROUP
a. The Human Resources Managers of the companies of the L’ORÉAL Group at country or Zone level (hereinafter called “the Human Resources Teams”) may, at their full discretion, use the EStrat Challenge concept in order, in particular, to organize events such as national or regional finals.
b. These events shall be organized independently from the Game.
c. The modalities of organization and or selection rules shall be defined by the organizing countries or Zones.
d. Every employee of L’ORÉAL responsible for relations with one or several campuses in one or several of the countries (hereinafter called “Campus Manager”) shall be free to work with a professor or professors and an administration or administrations of his/her choice and to use the L’ORÉAL EStrat Challenge as a teaching tool within the framework of a course or an academic project
e. Every Campus Manager shall be free to organize, or not, any other event around the L’ORÉAL EStrat Challenge in one or several schools of his/her choice.
XII. RELATIONS WITH THE MEDIA
The Students and/or Teams are not authorized to directly or indirectly contact the media and/or to meet journalists, except if they have obtained the express authorization of L’ORÉAL. Any Team or Student which contacts the media or journalists without the express authorization of L’ORÉAL shall be disqualified.

a. The round trip travel for the International Final for the 16 Finalist Teams as well as the accommodation in Paris will paid by L’ORÉAL .
b. The following prizes shall be awarded according to the final ranking of the Teams during the International Final:
1st Place: (MBA Team and Undergraduate Team having obtained the highest Final Mark): Participation in a trip worth a maximum of € 10,000 (taxes included, at the exchange rate applicable at the date of payment) by the winning Team (every member of the winning Team must have a valid passport). The 3 members of the Team shall not be obliged to travel together; they may share the above-mentioned amount and travel separately.
2nd Place: (MBA Team and Undergraduate Team having obtained the second highest Final Mark): A prize between €250 and € 650 at L’Oréal‘s discretion will be awarded to each member of the Team.
3rd Place: (MBA Team and Undergraduate Team having obtained the third highest Final Mark): A prize between € 250 and € 650 at L’Oréal‘s discretion will be awarded to each member of the Team
SPI Price: One price will be awarded to the team with the best SPI of each category among the 16 International Finalists teams
For the 16 Finalist Teams: a free subscription of one year to BusinessWeek magazine (paper edition).
For the 300 Semi-Finalist Teams: a one-year, free subscription to BusinessWeek online.
c. The prizes may not be exchanged for another prize or for money.
d. L’ORÉAL may not be held liable for the eventual poor performance of the product given as a prize or for its use.
e. All the prizes won during the Game must be taken and/or used by the winners during the year following the date of the International Final. At the expiry date, the Teams and/or the members of the Teams may no longer obtain their prize and may not obtain any compensation in cash and/or of any other nature if they have not claimed their prize during the above-mentioned period.
f. If there is a draw for the 1st, 2nd or 3rd Place, the winning Team shall be the Team that has obtained the best Presentation Mark. If the Teams to be separated have obtained the same Presentation Mark, the winning Team shall be the Team that has increased its SPI by the most between Round 1 and Round 5. If they are still tied, there will be 2 winning Teams. Each Team shall receive the prize described in point XIII a)
g. Every Team and/or member of the Team shall be fully responsible for the payment of any tax, contribution or amount of any kind relating to the Game’s prize.
XIV. SUPPLEMENTARY PROVISIONS
a. Disqualifications
At its sole discretion, L’ORÉAL may exclude or ban a Team from participating if the Team or one of its members does not comply with the Official Rules or acts in an unfair or disruptive way.
L'Oréal forbids the Teams, at any stage of the Game, to communicate their strategy to each other or any specific information concerning the Teams’ decisions and in particular, all data contained in the Team’s data file are private and highly confidential.
The L’ORÉAL EStrat software and its associated documentation are copyrighted.
All adaptation, reproduction or representation of this software without L’Oréal’s approval represents a forgery punished by the law.
The use of materials such as files from former EStrat editions or other EStrat players is not allowed. Quotations and reproductions or the use of developed concepts are prohibited.
The Teams shall have no recourse against the disqualification decisions.
L’ORÉAL has the right to sue any participant who might try to destroy, disturb, damage or affect the proper functioning of the Game.
b. Confidentiality obligation
By participating in the Game, the Students shall have access to information and various kinds of knowledge, in particular, commercial, financial, scientific, industrial or marketing information, concerning the activities, operations and studies of L’ORÉAL, one or several of the companies in the L’ORÉAL Group or one or several companies with which they are or were related or in which they are interested. The Students shall also have access to information concerning individuals belonging to the above-mentioned companies (hereinafter called the “Information”).
The Students shall take the measures necessary to keep the Information strictly confidential, except for the Information that has already fallen into the public domain.
The Students acknowledge that the disclosure of the Information would be likely to cause the L’ORÉAL Group considerable damage, permitting L’ORÉAL S.A. to engage their liability.
The confidentiality obligation shall continue after the end of the Game, for any reason whatsoever, until such time as the object of this clause ceases to exist.
c. Personal information
L’ORÉAL took appropriate measures, such as encoding, during the gathering of personal information to prevent, as far as possible, any unauthorized access. L’ORÉAL undertakes not to communicate to third parties (with the exception of their partners Google, BusinessWeek, StratX, within the framework of the defined partnership) the information provided at the time of Registration by the members of the Teams and only to use this data internally including other recruitment games organized and administered by L'ORÉAL.
According to the “Informatique et Libertés” Law of 4 January 1978, any Student can exercise his/her right of access and of modification or request the suppression of the personal data.
d. Reproduction rights
The Game is organized by the International Corporate Division for Strategic Recruitment of L’ORÉAL and is exclusively intended for contact with the student world. Any resemblance or similarity between the projects presented by the Students and the products developed by L’ORÉAL would be fortuitous. Since the projects are developed according to the ideas and the brief of L’ORÉAL and since a similar development may be in progress, none of the concepts presented by the Teams and/or Students during the Game may in any event be considered as having given rise to a concrete development. In the event where the products presented to L’ORÉAL by the Teams and/or Students, within the framework of their participation in the L’ORÉAL EStrat Challenge, give rise to an intellectual property right, the Teams and/or the Students shall assign to L’ORÉAL, which accepts them, all the rights of reproduction, representation, adaptation or translation associated with the products (designs, slogans, models, etc), over all the media, including those that are not yet known at the date of the Game, for any purpose (including commercial, promotional and advertising) throughout the statutory term of the intellectual property right, throughout the world and without any limitation in number. The assignment of rights is granted without any payment being made due as consideration.
The concepts provided by the Teams and the members of the Teams during the Game may be used free of charge and without restriction by L’ORÉAL.
By registering for the Game, the Student accepts gratuitously to guarantee for L’ORÉAL the right to use and publish his/her name, his/her profile, his/her photograph and his/her quotes on any type of medium for advertisements or for promotional purposes, without additional remuneration, throughout the world and on the web without limitation of duration. L’ORÉAL may also publish in whatever medium any results of the L’ORÉAL EStrat Challenge at any time for a reasonable duration.
e. Complaints
Any disputes concerning or arising from the Game shall be settled by the L’ORÉAL EStrat Challenge Committee. Any decision of L’ORÉAL shall be binding and final and the participants shall have no right of recourse.
These Official Rules are governed by French law and any dispute arising from the Game shall be brought before the competent French Court.
f. Miscellaneous
All the days and times stipulated in the Official Rules must be deemed to be the days and times within the Paris time zone.
The original of the Official Rules of the Game and its Appendices, deposited at the offices of Maître WAPLER, 45, Quai de la Seine, 75019 Paris, France, shall be the sole rules that are valid.
The Official Rules may be translated into several languages. In the event of disagreement, the French version shall be overriding.
L’ORÉAL reserves the right to shorten, modify or cancel the Game, especially in the event of bugs, viruses, unauthorized human intervention or other causes outside of the control of L’ORÉAL, that would bring into question the administration, the security or the proper functioning of the Game, without the Team or one of its members being able to claim for any loss against it.
The L’ORÉAL EStrat Challenge, its concept, its content, its appearance, its logo and any other graphic element and its organization are and shall remain the sole property of L’ORÉAL.
g. L’ORÉAL is not responsible for the entry errors of the Teams and of the members of the Teams, for the incorrect functioning of the site, for incorrect e-mail addresses related to the Game or for connection problems.
h. L’ORÉAL is not responsible for the contents of the sites visited during the Game. The use of these sites by L’ORÉAL does not mean that L’ORÉAL adheres to these sites or to their contents.
i. The Teams shall not be reimbursed for the equipment or resources used during their participation in the Game.
