The Terms of use for the game
a. Disqualifications
At its sole discretion, L'ORÉAL may exclude or ban a Team from participating if the Team or one of its members does not comply with the Official Rules or acts in an unfair or disruptive way.
L'Oréal forbids the Teams, at any stage of the Game, to communicate their strategy to each other or any specific information concerning the Teams' decisions and in particular, all data contained in the Team's data file are private and highly confidential.
The L'ORÉAL EStrat software and its associated documentation are copyrighted.
All adaptation, reproduction or representation of this software without L'Oréal's approval represents a forgery punished by the law.
The use of materials such as files from former EStrat editions or other EStrat players is not allowed. Quotations and reproductions or the use of developed concepts are prohibited.
The Teams shall have no recourse against the disqualification decisions.
L'ORÉAL has the right to sue any participant who might try to destroy, disturb, damage or affect the proper functioning of the Game.
b. Confidentiality obligation
By participating in the Game, the Students shall have access to information and various kinds of knowledge, in particular, commercial, financial, scientific, industrial or marketing information, concerning the activities, operations and studies of L'ORÉAL, one or several of the companies in the L'ORÉAL Group or one or several companies with which they are or were related or in which they are interested. The Students shall also have access to information concerning individuals belonging to the above-mentioned companies (hereinafter called the "Information").
The Students shall take the measures necessary to keep the Information strictly confidential, except for the Information that has already fallen into the public domain.
The Students acknowledge that the disclosure of the Information would be likely to cause the L'ORÉAL Group considerable damage, permitting L'ORÉAL S.A. to engage their liability.
The confidentiality obligation shall continue after the end of the Game, for any reason whatsoever, until such time as the object of this clause ceases to exist.
c. Personal information
L'ORÉAL took appropriate measures, such as encoding, during the gathering of personal information to prevent, as far as possible, any unauthorized access. L'ORÉAL undertakes not to communicate to third parties (with the exception of their partners BusinessWeek, StratX and Google, within the framework of the defined partnership) the information provided at the time of Registration by the members of the Teams and only to use this data internally including other recruitment games organized and administered by L'ORÉAL.
According to the "Informatique et Libertés" Law of 4 January 1978, any Student can exercise his/her right of access and of modification or request the suppression of the personal data.
d. Reproduction rights
The Game is organized by the International Corporate Division for Strategic Recruitment of L'ORÉAL and is exclusively intended for contact with the student world. Any resemblance or similarity between the projects presented by the Students and the products developed by L'ORÉAL would be fortuitous. Since the projects are developed according to the ideas and the brief of L'ORÉAL and since a similar development may be in progress, none of the concepts presented by the Teams and/or Students during the Game may in any event be considered as having given rise to a concrete development. In the event where the products presented to L'ORÉAL by the Teams and/or Students, within the framework of their participation in the L'ORÉAL EStrat Challenge, give rise to an intellectual property right, the Teams and/or the Students shall assign to L'ORÉAL, which accepts them, all the rights of reproduction, representation, adaptation or translation associated with the products (designs, slogans, models, etc), over all the media, including those that are not yet known at the date of the Game, for any purpose (including commercial, promotional and advertising) throughout the statutory term of the intellectual property right, throughout the world and without any limitation in number. The assignment of rights is granted without any payment being made due as consideration.
The concepts provided by the Teams and the members of the Teams during the Game may be used free of charge and without restriction by L'ORÉAL.
By registering for the Game, the Student accepts gratuitously to guarantee for L'ORÉAL the right to use and publish his/her name, his/her profile, his/her photograph and his/her quotes on any type of medium for advertisements or for promotional purposes, without additional remuneration, throughout the world and on the web without limitation of duration. L'ORÉAL may also publish in whatever medium any results of the L'ORÉAL EStrat Challenge at any time for a reasonable duration.
e. Complaints
Any disputes concerning or arising from the Game shall be settled by the L'ORÉAL EStrat Challenge Committee. Any decision of L'ORÉAL shall be binding and final and the participants shall have no right of recourse.
These Official Rules are governed by French law and any dispute arising from the Game shall be brought before the competent French Court.
f. Miscellaneous
All the days and times stipulated in the Official Rules must be deemed to be the days and times within the Paris time zone.
The original of the Official Rules of the Game and its Appendices, deposited at the offices of Matre WAPLER, 45, Quai de la Seine, 75019 Paris, France, shall be the sole rules that are valid.
The Official Rules may be translated into several languages. In the event of disagreement, the French version shall be overriding.
L'ORÉAL reserves the right to shorten, modify or cancel the Game, especially in the event of bugs, viruses, unauthorized human intervention or other causes outside of the control of L'ORÉAL, that would bring into question the administration, the security or the proper functioning of the Game, without the Team or one of its members being able to claim for any loss against it.
The L'ORÉAL EStrat Challenge, its concept, its content, its appearance, its logo and any other graphic element and its organization are and shall remain the sole property of L'ORÉAL.
L'ORÉAL is not responsible for the entry errors of the Teams and of the members of the Teams, for the incorrect functioning of the site, for incorrect e-mail addresses related to the Game or for connection problems.
L'ORÉAL is not responsible for the contents of the sites visited during the Game. The use of these sites by L'ORÉAL does not mean that L'ORÉAL adheres to these sites or to their contents.
The Teams shall not be reimbursed for the equipment or resources used during their participation in the Game.
